Medigin reserves the right at any time after the receipt of your order to accept or decline your order for any reason. Medigin reserves the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item or not supply an item. In the event an item is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, Medigin shall have the right to refuse or cancel any orders placed for product listed at the incorrect price.

These Website/Application terms and conditions constitute the sole record of the agreement between you and Medigin in relation to your use of the Website/Application. Neither you nor Medigin shall be bound by any express tacit or implied representation, warranty, promise or the like not recorded herein. Unless otherwise specifically stated these Website/Application terms and conditions supersede and replace all prior commitments, undertakings or representations, whether written or oral, between you and Medigin in respect of your use of the Website/Application.

Medigin may at any time modify any relevant terms and conditions, policies or notices. You acknowledge that by visiting the Website/Application from time to time, you shall become bound to the current version of the relevant terms and conditions (the "current version") and, unless stated in the current version, all previous versions shall be superseded by the current version. You shall be responsible for reviewing the then current version each time you visit the Website/Application.

Where any conflict or contradiction appears between the provisions of these Website/Application terms and conditions and any other relevant terms and conditions, policies or notices, the other relevant terms and conditions, policies or notices which relate specifically to a particular section or module of the Website/Application shall prevail in respect of your use of the relevant section or module of the Website/Application.

Medigin shall be entitled to cede, assign and delegate all or any of its rights and obligations in terms of any relevant terms and conditions, policies and notices to any third party.

Any relevant terms and conditions, policies and notices shall be governed by and construed in accordance with the laws of India without giving effect to any principles of conflict of law. You hereby consent to the exclusive jurisdiction of the High Court of Telangana in respect of any disputes arising in connection with the Website/Application, or any relevant terms and conditions, policies and notices or any matter related to or in connection therewith

If you have any questions, comments or concerns arising from the Website/Application, the privacy policy or any other relevant terms and conditions, policies and notices or the way in which we are handling your personal information please contact us.

By registering Your phone number and email with us, You consent to be contacted by Us via phone calls and/or SMS notifications or emails, in case of any order or shipment or delivery related updates and/or to update you about new offers and promotions. We will not share your personal information to any third party to initiate any promotional phone calls/SMS/emails.

At medigin, it is our constant endeavor to provide our customers with the quality drugs at competitive prices. If for some reason, customer wants to cancel an order, he/she can do this before we ship/process the order. Orders, which are processed, cannot be cancelled.

• Log into Medigin.in account and go to My Account --> Order history
• Select the order customer wish to cancel and click on Cancel button against the order

For the prepaid orders, which are cancelled, the amount will be refunded to the payment mode/account that was originally used to make the transaction.

Refund will be processed to the customer in the following cases:

• Prepaid orders:Orders which are cancelled by Medigin or Customer before processing, refund will be initiated automatically
• Prepaid orders and Returned:if for any reason, customer returns part/full of the order within 30 days after the invoice is generated, return will be approved only after thorough examination of the products delivered. In this case it is up to the discretion of the company to allow return either partially or fully.Refund will be generated after the examination
• COD orders:in the case of COD orders, return will be approved only after thorough examination of the products delivered. In this case it is up to the discretion of the company to allow return either partially or fully. However, for such orders, Exchange is allowed within 30 days after the invoice is generated.

For the cases above, the refund will be credited to customer account within 7 working days after the refund is generated.

At Medigin, it is our constant endeavor to provide best service to our customers and hence we assure customer the best delivery service.

Medigin will deliver the order at the customer doorstep. Customer will be informed about his order status during the entire process of the delivery

We strive to commit to the delivery time promised to the customer at the time ordering against each order. Customers are requested check for the promised delivery time while ordering medicines. Generally medicines are delivered with in 24 hrs from the confirmation of the order.

Prescription Drugs

• The Website/Application is a platform that can be used by the Users to purchase various drugs and pharmaceutical products that requires a valid medical prescription issued by a medical expert/ doctor to be provided to a registered pharmacist for the purpose of dispensing such medicine (“Prescription Drugs”), offered for sale on the Website/Application by Vendor. In order to purchase Prescription Drugs from Medicine Vendor through the Website/Application, You are required to upload a scanned copy of a valid prescription on the Website/Application or email/Whatsapp the same to MediGin The order would not be processed and forwarded to the Medigin until it receives a copy of a valid prescription. Medicine Vendor will verify the prescription forwarded by You and in case the observe any discrepancy in the prescription uploaded by You, the Medicine Vendor will cancel the order immediately. You are also required to make the original prescription available at the time of receipt of delivery of Prescription Drugs. If required by law you shall allow the delivery agent to stamp the original prescription at the time of medicine delivery failing which medicines will not be delivered.
• You authorize Medigin to maintain a record of all the prescriptions uploaded by You and to also include it in the EHR Services.

Substitution of Prescribed Drug

• You acknowledge and accept that the order for a substitute of a Prescription Drug would only be processed if the medical expert/ doctor has himself/ herself permitted for any other equivalent generic drug to be dispensed in place of the Prescription Drug and this fact is explicitly mentioned in the prescription or if the prescription solely lists the salt names instead of a specific brand name.
• You further acknowledge and accept that, in the absence of the above, the concerned Third-Party Medicine Vendor would not dispense a substitute drug in place of the Prescription Drug

• Your Medigin profile is created to store record of Your Consultations and Your personal health information online, including history, health conditions, allergies and medications.
• Any information provided as part of a web Consultation or obtained from use of the Services by you becomes part of Your Medigin record. You agree to provide accurate information to help us serve you best to our knowledge, to periodically review such information and to update such information as and when necessary. Medigin reserves the right to maintain, delete or destroy all communications and materials posted or uploaded to the Website/Application according to its internal record retention and/or destruction policies. You might be contacted via email to review the information provided by you for Medigin record or for the Services. Please make sure you provide a valid email-id and You update it as and when needed.
• The terms “personal information” and “sensitive personal data or information” are defined under the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011 (the “SPI Rules”).

1. The Privacy Policy sets out:

• The type of information collected from Users, including sensitive personal data or information;
• The purpose, means and modes of usage of such information; and
• How and to whom Medigin will disclose such information

2. The Users are expected to read and understand the Privacy Policy, so as to ensure that he/she has the knowledge of:

• The fact that the information is being collected;
• The purpose for which the information is being collected;
• The intended recipients of the information;
• The name and address of the agency that is collecting the information and the agency that will retain the information; and
• The various rights available to such Users in respect of such information.

3. Medigin shall not be responsible in any manner for the authenticity of the personal information or sensitive personal data or information supplied by the Users to medicine or any other person acting on behalf of Medigin

4. As a condition to your use of the Website/Application, You must be 18 (eighteen) years of age or older to use or visit the Website/Application in any manner. By visiting the Website/Application or accepting these Terms of Use, You represent and warrant to Medigin that You are 18 (eighteen) years of age or older, and that You have the right, authority and capacity to use the Website/Application and agree to and abide by these Terms of Use.

5. These Terms of Use is published in compliance of, and is governed by the provisions of Indian laws, including but limited to:

• The Indian Contract Act, 1872 ("Contract Act");
• The (Indian) Information Technology Act, 2000 ("IT Act") and the rules, regulations, guidelines and clarifications framed thereunder, including the (Indian) Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011, and the (Indian) Information Technology (Intermediaries Guidelines) Rules, 2011 ("IG Guidelines");
• The Drugs and Cosmetic Act, 1940 ("Drugs Act"), read with the Drugs and Cosmetics Rules, 1945 ("Drugs Rules");
• The Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954 ("Drugs and Magic Act");
• The Indian Medical Council Act, 1956 read with the Indian Medical Council Rules, 1957;
• Pharmacy Act, 1948 ("Pharmacy Act") and
• The Consumer Protection Act, 1986.
